These terms and conditions are only applicable to the website www.chocolaterieonline.com and are based on French law. They are applicable to the exclusion of all other terms and conditions.
ARTICLE 1 – PRICE
1.Price
Prices are given in Euros and include all taxes except shipping and handling costs, which are indicated separately. For delivery of orders to a country other than mainland France, the customer is considered to be the importer of the product(s) concerned. Customs’ duty or other State taxes may be applicable and are payable by the customer, not by CHOCOLATERIE DE PUYRICARD. Payment of these duties and taxes to the appropriate authorities and organizations, as well as any legal declarations, are entirely the responsibility of the customer. We recommend that you contact your country's authorities for information. All orders are payable in Euros, whatever the country of origin of the order. CHOCOLATERIE DE PUYRICARD reserve the right to modify prices at anytime, however, products will be invoiced at the tariffs applicable at the time of receipt of your order, subject to availability.
2.Products
The products put online on the www.puyicard.fr website are presented with their main characteristics (ingredients, weight, allergens, price, etc.) so that the customer has a complete view of the product he is consulting.
Alcohol abuse is dangerous to health. The sale of alcohol to minors under the age of 18 is prohibited. By accessing our sales, you declare that you are over 18 years of age.
ARTICLE 2 - ORDERING
Orders can also by placed by phone at +33 (0)4 42 63 39 53 between 9am and 5pm (France local time) Monday through Friday. Contractual information will be provided in French and this information will be confirmed on delivery at the latest.
ARTICLE 3 - CONFIRMATION
Our products are freshly made and we keep no additional stock. The manufacture of certain products can be halted temporarily or permanently due to the lack of availability or unacceptable quality of ingredients. As our primary objective is quality, we reserve the right to refuse a sale if this objective is not met. Our products are offered for sale subject to availability, which is linked essentially to ingredients availability and the absence of additional stocks. For packaging that is not stored at our laboratory, our products are subject to availability from our suppliers. If, after placing your order, the absence of a product or its packaging renders any part of your order unavailable we will inform you by e-mail or by telephone.

ARTICLE 5 - DELIVERY
Products are dispatched to the delivery address given at the time of ordering. The delivery times given are estimated times and take into account the preparation time and dispatch via the French postal service for products destined for mainland France and Monaco. If any articles are deliverable later as a result of temporary unavailability, the delivery time given is based on the supply of the delayed article(s). However, CHOCOLATERIE DE PUYRICARD reserves the right to supply orders in several deliveries. Only dispatched products are payable and CHOCOLATERIE DE PUYRICARD will refund any difference between the initial transaction and the products actually delivered. Postage and packing costs will be invoiced for one delivery. In the event of an unexpected delay, we will inform you by e-mail.
Shipping costs are 15.00 € including VAT per shipment in France excluding Corsica. These costs are offered to customers from 80.00 € TTC of purchase per shipment (excluding postage), always to metropolitan France excluding Corsica.
For orders to Corsica, shipping costs are 19.90 € per shipment (including tax); for orders over 80.00 € per shipment (excluding shipping costs), shipping costs are 4.90 € per shipment (including tax).
For any other country of delivery, the shipping costs for each shipment amount between 49.00€ and 99.00 € inclusive of tax, whatever the amount of the purchase.
ARTICLE 6 - PAYMENT
Credit card transactions and all security protocol are handled by our bank, Crédit Agricole. You can pay as follows:
- By credit card: Visa, MasterCard, American Express and other French “Cartes Bleues”.
- By Paypal.
- By check payable to 'CHOCOLATERIE DE PUYRICARD'
- By bank transfer/wire. If you choose this method, please call us to request our bank details.
For payments by check, we cannot dispatch your order until your check has been received, however urgent your order may be.
ARTICLE 7 - WEBSITE SECURITY
Our website is equipped with a secure payment system. We have adopted the SSL encrypting procedure, and we have further reinforced the data encryption and scrambling system to protect as effectively as possible all sensitive data linked to payment. Furthermore, none of your bank details are stored on our site. Online payment is carried out directly via the website and systems of our partner bank, Crédit Agricole. Our secure payment services follow the strictest and most rigorous application of the General Regulation on Data Protection (RGPD).

ARTICLE 11 - APPLICABLE LAW - DISPUTES
The present contract is subject to French law. The language of the present contract is French. Any dispute will be handled exclusively by the French courts.
In the event of a dispute, the Customer should first contact the Customer Service Department of La Chocolaterie de Puyricard in order to resolve it amicably. If this approach fails, the customer may use the online mediation service of the Centre de la Médiation de la Consommation des Conciliateurs de Justice (CM2C.net).
In order for the referral to the CM2C to be admissible, it must include: Your postal, email and telephone contact details as well as the full name and address of our company, a brief statement of the facts, and proof of the prior steps taken.
In accordance with the rules applicable to mediation, we remind you that a consumer dispute must first be submitted in writing to the Customer Service Department of Chocolaterie de Puyricard before any request for mediation can be made to the CM2C.
The mediator may not review disputes for which the request is manifestly unfounded or abusive, or which have been previously examined or are in the process of being examined by another mediator or by a court, or if the consumer made his request to the mediator more than one year after his written complaint to Chocolaterie de Puyricard. or if the dispute does not fall within the scope of the mediator's competence, or finally if the consumer does not justify having tried, beforehand, to resolve his dispute directly with La Chocolaterie de Puyricard by means of a written complaint according to the terms and conditions provided for, if applicable, in the contract.
